EVENT SERVICES AGREEMENT & BOOKING POLICIES

1. OUR COMMITMENT

At MAAR & Co. Photobooth Collective, we believe every event deserves a professional, thoughtful, and memorable experience.

MAAR is committed to providing the service booked according to the selected package or experience and the details expressly stated in the final booking confirmation. Our team will arrive prepared for the event, complete a professional setup, and provide the contracted services according to the confirmed details.

This agreement establishes the booking terms and the responsibilities of MAAR and the Client, including circumstances that may be beyond MAAR’s reasonable control.

2. BOOKING AND PAYMENTS

Regular online bookings require at least 7 days’ notice before the event.

Requests made less than 7 days before the event are subject to MAAR’s approval and availability. If accepted, 100% of the total is due at booking and the Rush Booking Fee will apply.

Selecting a date on the calendar or submitting a request does not guarantee availability and does not constitute a confirmed booking.

Bookings made with 8 days or more notice:

· 50% of the total is due at the time of booking.

· The remaining 50% is due 7 days before the event.

Bookings made exactly 7 days before the event:

· 100% of the total is due at the time of booking.

Bookings made less than 7 days before the event:

· Subject to MAAR’s approval and availability.

· 100% of the total is due at the time of booking if accepted.

· A Rush Booking Fee will apply.

For bookings made with 8 days or more notice, the remaining balance is due 7 days before the event. On the due date, MAAR will send the Client a reminder, and the Client will have 24 hours to complete the payment. If payment is not received within that period, the booking will be considered canceled and any payments made will be subject to the cancellation policy in this agreement. The 24-hour payment period does not extend the event date or otherwise modify the cancellation policy.

The event date and time will be considered confirmed once the applicable payment has been received and this agreement has been accepted.

3. SERVICES, CHANGES AND ADD-ONS

MAAR will provide the services, package or experience, service hours, backdrop, customizations, and additional services expressly listed in the final booking confirmation.

The final booking confirmation is the primary reference for the services purchased. Any service, product, benefit, or item that is not expressly included in the confirmation will not be considered part of the booking.

Any add-on, package change, additional hour, additional backdrop, magnets, keychains, or other service must be requested at least 4 days before the event.

Additional services are subject to availability. MAAR will not charge for an additional service until its availability has been confirmed. Once MAAR confirms availability, the Client will have 12 hours from that confirmation to pay the applicable amount. An additional service will be considered confirmed only after payment is received.

Services or extras requested on the day of the event are not guaranteed.

Customizations and materials provided by the Client must be submitted within the deadlines specified by MAAR in order to be prepared for the event.

Custom designs must be approved by the Client at least 72 hours before the event. If the Client does not provide approval or requests changes after that deadline, MAAR may use a standard design to ensure the service can be properly prepared and operated. Late changes may not be accepted.

Custom designs created by MAAR for the booking may be used by the Client together with the photographs and digital materials provided as part of the service. MAAR retains its rights to the original templates and creative materials used to create those designs. These materials may not be reproduced or commercially reused by another photobooth company or third party without MAAR’s authorization.

Any modification, request, or change related to the booking must be expressly approved and confirmed by MAAR through the company’s official email, booking@maarphoto.com, for the change to be valid and become part of the booking. Requests or conversations made through other channels will not, by themselves, modify the terms of the booking.

4. EVENT, SERVICE HOURS AND CLIENT RESPONSIBILITIES

MAAR will provide service during the contracted hours listed in the final booking confirmation. Setup and breakdown time are not included in the service hours unless expressly stated otherwise.

The Client must provide MAAR with timely access to the event venue, sufficient, safe, and suitable space for setup and operation, an adequate power source, and any permissions required by the venue.

· Standard packages: minimum 10 × 10 ft of suitable space.

· Interactive experiences: minimum 14 × 18 ft of suitable space.

Additional space may be required depending on the selected backdrop or add-ons. MAAR will communicate any applicable space requirements.

The Client must provide a safe, functional standard 120V, three-prong electrical outlet located within 15 feet of the MAAR setup area. If the available power source is more than 15 feet away or the venue has additional electrical requirements, the Client must notify MAAR in advance so an appropriate arrangement can be confirmed.

The Client must inform MAAR of any venue-specific requirements, restrictions, procedures, permits, or costs that may affect access, setup, or operation, including parking, valet, loading or unloading, vendor access, freight elevators, union labor, security or escort requirements, access permits, electricity, internet, or other venue charges or conditions. The Client will be responsible for managing and paying such costs when necessary for MAAR to access the venue and provide the service.

For outdoor events, the Client must provide an area suitable for the setup and operation of the equipment. If the conditions of the location or weather prevent the equipment from being operated safely outdoors, the Client must provide a covered and suitable space so that MAAR can provide the service.

Direct sunlight, excessive heat, humidity, rain, or other environmental conditions may affect equipment operation or safety. If conditions make operation unsafe, MAAR may pause service until the equipment can be moved to a suitable and protected area.

Delays caused by the Client, guests, venue, or outside vendors will not automatically extend the contracted service hours. The contracted schedule will not automatically be adjusted due to delays in the start of the event, and service time lost due to such circumstances is not refundable.

The Client must inform MAAR of any relevant changes to the event date, time, venue, address, or special requirements. Any change is subject to MAAR’s approval in accordance with Section 3.

5. EQUIPMENT, DAMAGE AND CONDUCT

All equipment, props, backdrops, cameras, printers, tablets, lighting, displays, and other MAAR property must be used carefully, appropriately, and in accordance with the instructions of MAAR staff.

Food or beverages should not be placed on or near MAAR equipment when they could create a risk of damage.

The Client will be responsible for any damage, loss, or theft of MAAR property caused by the Client, guests, vendors, venue staff, or other persons associated with the event, when such damage exceeds normal wear and tear.

The Client must cover the reasonable cost of the applicable repair or replacement.

If damage is identified after the event, MAAR will document the damage and notify the Client within 5 business days. The Client will have 7 days from the date of notice to pay the applicable repair or replacement cost.

The payment method or card stored and used to make the booking may be used to charge the applicable amount after the Client has been provided notice of the damage and the applicable repair or replacement cost.

MAAR will be responsible for performing a proper and safe installation of its equipment and for the professional conduct of its staff.

The Client will be responsible for the conduct of guests, vendors, venue staff, and other persons associated with the event.

MAAR will not be responsible for injuries, damage, or losses resulting from improper use, movement, alteration, or interference with MAAR’s equipment or installation by the Client or a third party.

The Client must ensure that guests and other persons associated with the event do not manipulate, move, or interfere with MAAR equipment, cables, or other elements of the installation.

MAAR may suspend or stop service when a situation presents a risk to the equipment, staff, guests, or venue, including aggressive behavior, unsafe use of equipment, intentional damage, or harassment of staff. In these circumstances, MAAR is not required to extend the service hours or refund time lost due to such conduct.

6. CANCELLATION

Cancellations are subject to the following terms:

More than 30 days

A 25% cancellation fee will apply, and the remaining 75% of eligible payments will be refunded. The Client may alternatively choose one reschedule and transfer 100% of payments made.

30–11 days

Payments made are non-refundable. One reschedule is permitted, subject to MAAR’s availability and Section 7.

10 days or less

Payments made are non-refundable and rescheduling is not permitted.

If the Client cancels or interrupts the event on the scheduled event date, the booking will remain non-refundable and will not be eligible for rescheduling under the original terms, regardless of whether MAAR has arrived at the venue or begun setup. Any future date will require a new booking, subject to current availability, pricing, and terms.

7. RESCHEDULING

When rescheduling is permitted under Section 6, MAAR allows one reschedule per booking.

The new date must be within 12 months of the original event date and is subject to MAAR’s availability.

The booking will retain the package, experience, and services originally purchased.

If the Client wishes to select a higher-level package or experience for the new date, they may do so by paying the applicable price difference, subject to availability.

If the new date has a different applicable rate than the original booking, the Client is responsible for any applicable price difference.

Once a booking has been rescheduled, it may not be rescheduled again.

8. CIRCUMSTANCES BEYOND MAAR’S CONTROL

MAAR will take reasonable and appropriate measures to provide the contracted service. However, certain circumstances beyond MAAR’s reasonable control may prevent or affect the provision of service, including extreme weather, natural disasters, fire, flooding, emergencies, power outages, venue restrictions or closures, access issues, circumstances affecting safe access to or safe operation at the venue, public service interruptions, internet or Wi-Fi failures, third-party services, actions by authorities, or other similar circumstances.

When circumstances permit, MAAR will work with the Client to find an appropriate solution, including a possible reschedule.

MAAR will not be responsible for losses, delays, or interruptions caused exclusively by such external circumstances or by the actions or omissions of third parties.

9. MAAR’S RESPONSIBILITY

MAAR is committed to providing the contracted services in a professional manner.

Routine brief operational interruptions may be necessary during contracted service hours, including changing paper or ribbon, restarting software, adjusting camera settings, reconnecting equipment, or addressing minor operational issues. These interruptions are part of normal service operation and do not automatically result in additional service time or a refund. MAAR will take reasonable steps to minimize such interruptions and resume service as soon as reasonably possible.

If equipment failure or a situation directly attributable to MAAR significantly affects the provision of service, MAAR will take reasonable and appropriate measures to repair, replace, or resolve the issue.

Depending on the circumstances, MAAR may offer an alternative solution, replacement equipment, additional time, rescheduling, or a full or partial refund, as appropriate.

Any refund issued by MAAR in connection with the booking will not exceed 100% of the amount actually paid by the Client for that booking.

MAAR will act in good faith to find a fair and appropriate solution based on the circumstances of each situation.

10. ACCEPTANCE AND GOVERNING LAW

By completing the booking and electronically accepting this agreement, the Client confirms that they have read and understood the booking, payment, cancellation, rescheduling, and responsibility terms set forth in this document and agrees to its terms.

This agreement will be governed by the laws of the State of Tennessee.

Any legal action arising from or related to this agreement must be filed in the appropriate court located in Davidson County, Tennessee, unless applicable law provides otherwise.
